Terms of service

1. Who we are

INSTATuner is a browser-based ECU file editor and tuning library, operated by Tuning-Database (the "Operator"). Service domain: instatuner.tuning-database.co.uk. Identity provider, billing, and customer service: tuning-database.co.uk.

2. Acceptance

By creating an account, signing in, or completing a paid subscription, you agree to these Terms, the Privacy Policy, the Cookies Policy, and the Refund Policy. If you do not accept any of them, do not use the service.

3. Account & device binding

Sign-in goes through your tuning-database.co.uk account. Each account is bound to a maximum of 2 active devices, identified via browser fingerprint + cookie. Adding a third device requires you to revoke an existing one. Sharing the account across more than 2 active devices is a material breach and we may suspend the account without refund.

You must keep your password confidential. We are not responsible for losses caused by you sharing credentials.

4. The service — what you get

  • Access to the AI File Editor (map browser, cell editor, hex viewer, DTC editor, dyno generator, A/B compare, drafts, undo/redo, real BIN export with checksum recompute).
  • Access to the catalog of community-published Original / Stage 1 / Stage 2 / Stage 3 files where available for your vehicle.
  • Operator-defined per-tier quotas (auto-match runs, downloads, storage). Quotas reset monthly.
  • Email support per the SLA published on the marketing pricing page at the time you subscribed.

5. Content & intellectual property

ECU files distributed through INSTATuner remain the property of their original publishers (the Operator, partner tuners, or community contributors). Your subscription grants you a non-exclusive, non-transferable, non-sublicensable licence to download and use those files for legitimate tuning work on vehicles you own or are explicitly authorised to modify. You may not redistribute, repackage, resell, mirror, or train AI models on library files.

Files you upload to your own account remain yours. By uploading, you grant us a limited licence to store, hash, deduplicate, scan for safety, run pattern matching against, and serve them back to you. We do not redistribute your uploads to other users.

6. Acceptable use

  • No reverse-engineering of the platform code, the obfuscated client bundles, or the central analyzer endpoints.
  • No automated scraping. The 2-device cap, per-IP rate limits, and per-feature quotas are enforced.
  • No use that breaches manufacturer warranties, vehicle homologation rules, or emissions law in your jurisdiction. You are solely responsible for compliance.
  • No upload of malware, exploit payloads, copyrighted material to which you have no rights, or content disguised as an ECU binary.
  • No use of the service for any vehicle that is not yours or for which you do not have explicit modification authorisation from the owner.

7. Subscriptions, billing, and renewals

Subscriptions are billed by the WooCommerce checkout on tuning-database.co.uk via a payment processor (Stripe, PayPal, or similar). Plans renew automatically on the chosen cadence (monthly / yearly / lifetime) unless cancelled before the renewal date. Cancellation takes effect at the end of the current billing period.

Lifetime plans are one-time payments. They include the editor + library access at the tier you bought, for as long as the service operates and at the feature scope reasonably equivalent to what was advertised at the time of purchase.

Refunds are governed by our Refund Policy. In short: digital subscriptions are non-refundable once provisioned, with narrow exceptions for duplicate charges, provisioning failures, unauthorised charges, and material outages.

8. Liability

Important: Tuning ECU files materially changes the behaviour of safety-critical engine, transmission, and emissions systems. You are SOLELY responsible for verifying the suitability of any tune for your hardware and for compliance with road-traffic and emissions regulations in your jurisdiction.

The service and any artefact downloaded or generated through it (BIN, .tune sidecar, dyno PDF, AI suggestion) are provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law:

  • We are NOT liable for damage to your vehicle, third-party vehicles, persons, or property arising from a flashed file.
  • We are NOT liable for warranty voids, insurance refusals, or homologation issues caused by your use of the service.
  • We are NOT liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
  • Our aggregate liability for any direct damages is capped at the total amount you paid us in the 12 months preceding the claim.

Nothing in this section limits liability for death, personal injury caused by gross negligence, fraud, or any other liability that cannot be limited by applicable law.

9. Suspension & termination

We may suspend or terminate access for material breach (abuse, automated scraping, security violations, chargeback fraud, redistribution of library files, illegal use). Your uploaded data is preserved for 60 days after termination so you can request export; after 60 days it is permanently deleted, except where retention is required by law (financial records, audit logs).

10. Changes to the service

We may add, modify, or remove features. Material reductions in the feature set during your paid period are communicated via email at least 30 days in advance and qualify you for a pro-rata credit toward a different tier — never a cash refund.

11. Changes to these Terms

Material changes are announced via email and via the public changelog at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

12. Governing law and forum

These Terms are governed by the laws of the Operator's registered jurisdiction. Disputes go to the courts of that jurisdiction unless local consumer-protection law gives you a different mandatory forum.
